The City retains the right and privilege to cut or move any Telecommunications facilities located within the public ways of the City and upon City property, as the City may determine to be necessary, appropriate or useful in response to any public health or safety emergency. The City shall not be liable to any Telecommunications provider, or any other Person for any direct, indirect, or any other such damages suffered by any Person or entity of any type as a direct or indirect result of the City’s actions under this section. The City shall attempt to contact the Telecommunications provider and provide an opportunity for the Telecommunications provider to perform the necessary cutting or moving unless the emergency necessitates City action prior to such contact.
