Unless directly and proximately caused by the sole negligence or willful misconduct by the City, the City shall not be liable for any damage to or loss of any Telecommunications facilities upon City property or within the public ways as a result of or in connection with any public works, public improvements, construction, excavation, grading, filling, or work of any kind on such City property or within the public ways by or on behalf of the City nor shall the City be liable with respect to any actions in connection with Section 12.14.570 above.
